Supplier Responsibility and Warranty
Seller’s Liability for Defects
1. Claims against the supplier for damages are time-barred after three years from the moment the affected party became aware, or should have become aware, of the damage, the defect, and the identity of the manufacturer. After ten years from the release of a specific product, the rights of the damaged party against the manufacturer will be extinguished. If there is any doubt regarding the identity of the manufacturer of a product you purchased from us, please inform us.
2. DALCOCHEM S.A. has all the obligations toward you, as prescribed by the Civil Code for sellers. Specifically, in the case of a defect in the product you have purchased, you may (a) request the repair of the product at no additional cost to you or its replacement with another, unless this is impossible or would incur disproportionate costs; (b) request a reduction in price; and (c) withdraw from the contract, unless the defect is trivial. These obligations do not apply if the defect was caused by you, or by force majeure in a narrow or broad sense. In every case, the products must be accompanied by the necessary legal documents and proof of receipt.
